Lawsuit Alleges Spirit Airlines Flight Attendant Liquored Up Passenger, Then Groped Him

A Spirit Airlines flight attendant has been accused of making unwanted sexual advances against a passenger, including groping him in the rear galley.

Spirit Airlines Faces Lawsuit From Passenger Who Says Flight Attendant Groped Him

The complaint alleges that a Spirit Airlines flight attendant offered several bottles of free liquor to a passenger, asked him to retreat to the rear galley, then sexually assaulted him.

To protect his identity, the passenger is suing under the initials MB. His lawsuit is against Spirit Airlines, which accuses the airline of negligence and asserts that Spirit Airlines “should have known” about the flight attendant’s “propensities to sexual violence, physical violence and sexual deviance.”

The incident occurred on a June 30th flight from Myrtle Beach, SC (MYR) to Philadelphia (PHL). First, the flight attendant presented the passenger with a free water bottle. He “soon returned, winked at Plaintiff and pushed mini bottles of Jack Daniels into his chest.” Shortly thereafter, he returned again, this time offering more whiskey and giving his number to the passenger written on a napkin.

Toward the end of the flight, the flight attendant called the passenger back to the rear galley. Without warning, the flight attendant “grabbed, groped and fondled Plaintiff’s penis and private area” and “then tried to unzip Plaintiff’s pants.”

The passenger darted into a lavatory, then returned to his seat when the coast was clear.

After the flight, the passenger texted the flight attendant in an attempt to get his name. The flight attendant apologized for the onboard incident, noting he “didn’t mean to be disrespectful.” Nevertheless, the passenger reported the incident to the Federal Bureau of Investigation (FBI) after Philadelphia police turned down the case because it happened in the air.

Although the lawsuit suggests the flight attendant has a record of deviant behavior, that does not appear to be established in the record:

“Upon information and belief, Spirit Airlines failed to conduct a thorough background check or reference check…Had Spirit Airlines conducted such a check, it would have discovered the concerns raised herein.”

MB is also suing Spirit for assault, battery, and gross negligence in its hiring and supervision and is seeking damages of $150,000. The case was filed in the US District Court for Eastern Pennsylvania.

CONCLUSION

The allegations are disturbing and if true, the flight attendant should be fired and face civil penalties for his actions. Whether Spirit should have known the alleged proclivities of this flight attendant may be a stretch, but Spirit is on the hook for the conduct of its employees on the job.

    Sounds like the next #metoo scam. No one deserves to be fondled against their will, but at a certain point this guy accepting (and presumably consuming) all of the alcohol, then following the FA to the back, you can hardly blame the FA for thinking maybe the guy was into it?
