An Oregon man exposes the folly of too much alcohol consumption and the potentially destructive combination of drinking and flying. His tip-sy behavior on an American Airlines flight forced a diversion and may leave him shafted in prison.

For 25-year-old Neil McCarthy, the day began innocent enough. The Oregon resident showed up for his American Airlines flight from Portland (PDX) to Manchester, New Hampshire (MHT) via Chicago (ORD). To take the edge off, he had a drink…a Jack & Coke…and then another and then another.
McCarthy purportedly told police officers he had downed “several” Jack & Cokes in Oregon and then “several more” during his layover in Chicago O’Hare.
The flight to Chicago went smoothly enough, but things went downhill fast on the connection to Manchester. Somewhere over New York state, McCarthy rose from his first class seat but instead of walking the five feet to the lavatory, dropped his trousers and urinated on the cabin floor.

When I first saw the pictures above, I figured this occurred before landing when the seat belt light was on and he was told he could not use the lavatory but found he could not hold it.
Not so, apparently. Instead, this just happened midflight—presumably because of his inebriated state. His “bathroom break” forced the flight to diver to Buffalo Niagara International Airport (BUF) where police boarded the plane to arrest him.
US Attorneys have chosen to prosecute him and he stands accused of indecent exposure and faces a $5,000 fine and a six-month prison sentence if convicted.
Beyond that, American Airlines has banned him and he faces registry as a sex offender.
Once again, the lesson is that alcohol consumption and flying are not always a happy combination. If you are a nervous flyer, may I suggest a different coping mechanism…

That is how it is in many states if a child is in the same room or in sight. I had an employee once arrested for exposure in an airport bathroom (toe tapping at urinals in ATL baggage claim – at 68 years old). They added some sort of sexual indecency with a minor or similar because a child was in the bathroom at the time (was in a stall with the door shut). That part wrecked his life as he lived with his sister and great niece and he had to move. Yeah he deserved punishment but that extra charge seemed like a little stretch given the circumstance. But that was state statute by definition.

You are incorrect. The federal regulation prohibiting indecent exposure is found in 25 CFR § 11.408. This statute states that “a person commits a misdemeanor if he or she exposes his or her genitals under circumstances in which he or she knows his or her conduct is likely to cause affront or alarm. ” If it involves aggravating factors or repeat offenses, penalties can include fines, imprisonment, and mandatory registration as a sex offender.
Indecent exposure is obviously a sex offense. Get your head out of the sand Derek.
This is why there ought to be one U.S. Marine in every airline cabin … to deal expeditiously with any idiots : knock them out with a roundhouse , at the slightest hint of trouble .

And in addition to that first roundhouse punch, add a strong kick to the groin for doing this in First Class. That kind of idiocy certainly belongs back in Coach.
I’ve got a great photo from my AirTran days of a redeye flight where somebody drunk and on drugs got cut off so he beat up his mother, got separated, then decided he wanted to go talk to the Captain. He started charging up the aisle and the F/A in the front flicked the cabin lights from off to BRIGHT and body blocked him at the bulkhead. The plane basically nosedived for Lubbock or Amarillo to offload. The photo has three US servicemen in their camos on top of the guy. They landed with these gentlemen on top of the offender on the aisle floor in Business Class. I remember talking to the F/A later who told me when they opened the door and the police were waiting, the soldiers basically lifted the guy and handed him out the door like a bag of trash.
Absolutely glorious.
If he had a job I would imagine he no longer does now. I’ve heard of people doing weird stuff when drinking and taking ambien etc but pulling out your willy in front of your fellow passengers is a new one. I hope they deplaned off stairs at the rear…
Similarly, whatever savings he has, he will have substantially less quite soon. He’s going to want an experienced lawyer to help him avoid sex offender status, which can be a lifelong punishment, and that’s going to be costly.
There are some current and former politicians, judges and cabinet secretaries/ministers in the US and Europe who have “whipped it out” in front of a shocked crowd of sorts. And some of those government figures have even taken a leak in the open with an audience unfortunately in attendance or around to notice the aftermath. Fortunately for most of them it was in a time before “spreading the news” was so easy and before everyone had a camera with them just about 24/7.
People are less forgiving of gross nonsense nowadays, and people with such gross behavior can never be certain that their past behavior won’t come back to haunt them.
If booze was the only factor, he had more than just several drinks to behave like that.
Booze and benzodiazepines can really mess one up. Not excusing the behavior, one has a personal responsibility to act appropriately.

If he needs a US passport or has one, he’s in line for a sex offender designation in his US passport even after he pays his fine and does any ordered time behind bars if the prosecutor tries to nail him for there being minors on the plane. If that happens, then he is no longer going to be eligible for a US passport card.
For extra fun, if he gets put on the SO registry for a limited period of time, 10 years for example, and then comes off the registry, but then goes to a state where registration would be lifelong for his crime, he’ll then have to register for the rest of his life. And a large number of countries won’t allow him in even if he can get a passport with an SO designation.
Oh, and registry laws in the past have been changed in a retroactive fashion- so you can serve your time, get off the registry, be free and clear for a decade, but the a new law is made and you’re back on.
I’m not a fan of sex offenders and I’m glad we have a registry, to a certain degree, but I don’t think that most people understand how serious it is. Many people who go through it say that living in the community on the registry is worse than their prison time was.
