Family Sues American Airlines Over Flight Attendant Who Placed Camera In Lavatory To Surreptitiously Film Teenage Girl

The family of a 14-year-old who was surreptitiously filmed by a pervert flight attendant in an aircraft lavatory is suing American Airlines and the flight attendant.

American Airlines Faces Lawsuit Over Hidden Camera In Lavatory Placed By Flight Attendant

Per the family attorney, a 14-year-old girl rose to use the lavatory in economy class on September 2, 2023. There was a line. A male flight attendant approached her and told her she could use the first class lavatory, but he needed to wash his hands first. He remained in the lavatory for approximately one minute. Stepping out of the lavatory, he told her that the toilet seat was broken (not the toilet itself).

When she entered the lavatory, she purportedly observed red tape over the toilet seat, but then noticed a mobile camera taped on the seat. The camera (flash) light was on, suggesting it was recording. She snapped a picture of it (below, released by Lewis and Llewellyn LLP).

Upon stepping out of the lavatory, the same flight attendant went back in and came out moments later.

Understandably, the family is now seeking a payday via a lawsuit against American Airlines and the flight attendant. Causes of action include:

Against the flight attendant:

  • invasion of privacy
  • civil liability for the criminal act of secretly peeping
  • intentional infliction of emotional distress

Against American Airlines:

  • negligence
  • negligent hiring, supervision or retention
  • negligent infliction of emotional distress

The lawsuit was filed in federal court in the Western District of North Carolina. The family released the following statement describing the lawsuit:

“We brought this lawsuit to hold American Airlines and the flight attendant responsible for what happened to our daughter. In the three months since the incident happened, no one from American Airlines has even bothered to reach out or check on our daughter’s well-being. This must never be allowed to happen again.”

I’d wager a guess that this lawsuit has little to do with AA’s failure to reach out.

The lawsuit does provide us with a few more details about the incident:

  • The father demanded that the male flight attendant show him his phone, but gave the FA time to get it, which also gave him time to delete the offending photos
  • “withheld from service” immediately after the alleged incident and has not worked since.

CONCLUSION

It is no surprise that the family has filed a civil lawsuit against the “John Doe” flight attendant and American Airlines for what occurred onboard. I expect a generous settlement to make this case go away…which was probably the plan from the start.

    Seriously, Matthew?! It’s the family that had “the plan from the start?” So was the FA who allegedly engineered and activated the system just a bystander-victim of the whole event?

    The family suffered no harm. Shame on them. Different story if the passenger didn’t notice it in time and pulled down her pants.

    Pay me because I got emotional distress from the lawsuit being filed. American Airlines should budget a certain amount to fight.

    Obviously the employee should be charged & tried in a court of law, and fired but otherwise this is another money grab. I hope AA fights this but in most cases it’s cheaper to pay a nominal sum and make it go away.

    Oh yes. The family planned this but the nonce who tried to videotape their daughter should go unpunished. The airlines has a duty or care to its pax. Wonder if you would talk about it being the plan all along if this happened to you (not that I wish this on anyone).

    What is the plaintiff alleging? That AA told their FA’s it was ok to commit crimes? Or that AA didn’t engage in basic measures to vet their employee’s history? That’s HR 101. Unless there was a coverup (such as in the recent case of the off duty FA woman who groped another woman), that dog probably won’t hunt. There is no significant damage since it was avoided. Someone allegedy TRIED to take a picture of their daughter.

    This is probably about trying to swamp AA with discovery fees and costs to want to make it go away.

    In the meantime, Matt should check out Mike Tyson being shook down by Melvin Townsend who harassed the champ and got punched over it with the primary damage being the guy’s suffering humiliation for harassing Mike Tyson. I wish I was on that jury, I’d find for Mike as a victim of inflection of emotional distress.
